01Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you (or the organization you represent) and Somatic Wellness Consulting FZC, a company registered in the Ajman Free Zone, United Arab Emirates and operator of the Wathiqa platform ("Wathiqa", "we", "us"). They govern your access to and use of the Wathiqa platform, including all features, tools, and generated content.

By creating an account, you confirm that you are at least 18 years old and have the authority to bind the organization you represent to these Terms.

02The Service

Wathiqa is an AI-powered platform that generates gender equality policy packages for organizations. Each policy package consists of four documents: a Policy Document, Procedural Guide, Activation Plan, and Monitoring Guidelines.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice to users where practicable.

03Accounts and Registration

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access.

One account may be used by multiple team members only on the Organization plan. Sharing account credentials across organizations is prohibited.

04Credits, Billing, and Refund Policy

Access to policy generation is governed by a credit system. Credits are purchased in packages:

• Free — 1 credit at no charge
• Starter — 5 credits for $29
• Growth — 20 credits for $99
• Organization — 60 credits for $279

Credit expiry: Credits expire 12 months from the purchase date of each package. Expired credits are forfeited and non-refundable.

Refunds: Refund eligibility depends on whether a credit has been redeemed. Credits you have purchased but not yet redeemed may be refunded within 14 days of purchase; once a credit is redeemed to generate a policy package the digital content has been delivered and that credit is non-refundable. EU and UK consumers retain their statutory withdrawal rights. Full details — including billing errors, credit expiry, and recurring plans — are set out in our Refund Policy. If you believe a charge was made in error, contact us within 14 days at wathiqaapp@gmail.com.

Payment processing: Somatic Wellness Consulting FZC is the seller of record for every purchase made through the Wathiqa platform — whether paid by card or invoiced directly — and these Terms govern that sale. Card payments are processed on our behalf by Stripe, Inc. ("Stripe"), a PCI DSS Level 1 certified payment processor; Stripe acts solely as our payment processor, not as a reseller or Merchant of Record, and such card purchases are additionally subject to Stripe's own Services Agreement. We never receive or store your full card details — all card data is collected and handled directly by Stripe.

For business customers located in the European Union who provide a valid VAT identification number, purchases are billed under the reverse-charge mechanism: we do not charge VAT, and you are responsible for self-accounting for VAT in your own jurisdiction in accordance with EU VAT rules (Council Directive 2006/112/EC, as amended). Invoiced and other EU B2B reverse-charge purchases continue to be billed directly by Somatic Wellness Consulting FZC.

Prices may change with 30 days' written notice to registered users. Existing credit packages purchased before any price change are not affected.

05Generated Content

Policy documents generated through the Wathiqa platform are provided for informational and organizational use. They are not legal advice. We recommend you review generated policies with qualified legal counsel before implementation, particularly for jurisdictions with specific regulatory requirements.

You own the generated policy documents produced for your organization. We retain no rights to your generated output beyond what is necessary to deliver and improve the Service.

We do not guarantee that generated policies will be legally sufficient for any specific jurisdiction, regulatory framework, or organizational context. Wathiqa is a policy generation tool, not a legal service.

06Acceptable Use

You agree not to:

• Use the Service to generate content intended to harm, deceive, or discriminate against individuals or groups
• Attempt to reverse-engineer, scrape, or extract the platform's AI models or policy templates
• Share or resell generated policy packages to third parties without our written consent
• Use the Service in any way that violates applicable laws or regulations
• Provide false or misleading organizational profile information that would misrepresent the intended use of generated policies

07Intellectual Property

The Wathiqa platform, including its design, policy templates, AI models, and all software, is owned by Somatic Wellness Consulting FZC. Your use of the Service does not transfer ownership of any platform IP to you.

You retain ownership of data you input into the platform and policy documents generated for your organization.

08Limitation of Liability

To the maximum extent permitted by applicable law, Wathiqa and Somatic Wellness Consulting FZC are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months prior to the claim.

The Service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose or regulatory compliance.

09Termination

You may close your account at any time from your Settings page. Upon closure, your generated policies are retained for 30 days before permanent deletion, and unused credits are forfeited.

We may suspend or terminate your account for violations of these Terms, with written notice where reasonably possible.

10Governing Law

These Terms are governed by the laws of the United Arab Emirates and, where applicable, the Emirate of Ajman, where Somatic Wellness Consulting FZC (Ajman Free Zone) is registered as the operator of the Wathiqa platform. Any disputes not resolved through direct communication shall be subject to the jurisdiction of the competent courts of the UAE. Users in the EU retain all rights granted by EU consumer protection law regardless of this clause.

11Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
